SC Dismisses “Misconceived” PIL Seeking Uniform Scheme of Compensation for Victims of Violence and other Tragedies

The Supreme Court Monday dismissed a Public Interest Litigation (PIL) seeking a direction to enact law providing for a uniform scheme of compensation for persons affected by violence and other tragedies.

Terming the PIL misconceived, a three-judge bench of Justices DY Chandrachud, Indu Malhotra and Indira Banerjee said that the law on the point is well-settled that no mandamus can be issued to Parliament as a legislating body to enact legislation.

“The prayers are hence misconceived. Moreover, whether any scheme should at all be framed by the executive is a matter of policy. We, therefore, decline to entertain the petition under Article 32 of the Constitution”, the bench added.

The plea filed by one BS Rajesh Agrajit had asked for a direction to the Central Government to formulate, enact and implement a strong uniform scheme for awarding compensation to Indian citizens for injuries or deaths due to Terrorism or Maoist violence or mob lynching etc, to martyrs, rape victims, stamped, govt. employees who die on duty, riot victims, COVID l9 warriors, victims of custodial deaths, Bhopal gas leak or Vizag gas leak, cyclone, Bestial acts etc.

The petitioner also sought a direction to formulate, enact and implement a strong uniform scheme for awarding gifts to any individual or group while achieving any gold, silver or bronze medal or position i. India or across the world like Olympic, Asian games, commonwealth games/ world cup etc.
